About these terms

These terms apply between you and Pacific Containers Terminal whenever you access this website or place an order through it. By using the website you accept these terms. If you do not accept them, please do not use the site.

These terms should be read together with our Terms of Sale, Shipping & Delivery Policy, Returns & Refund Policy, Cancellation Policy, Payment Information and Privacy Policy, each of which forms part of the agreement between us.

Use of this website

You agree to use this website lawfully and not to attempt to interfere with its operation, security or availability.

You may not scrape, republish or resell our product descriptions, specifications, photography or pricing without written permission, use automated tools to place speculative orders, or submit false customer, billing or delivery details.

We may suspend access or refuse an order where we reasonably believe the ordering system is being misused.

Account and order information

You are responsible for the accuracy of the details you submit at checkout, in particular the delivery address, contact telephone number and site access information. Incorrect details are the most common cause of failed deliveries and re-delivery charges.

Order history shown in your account area is stored in your own browser. Clearing browser storage removes that local record; it does not cancel or alter an order already placed with us.

Product information and photographs

We aim to describe container type, size, condition grade, dimensions and specification accurately and consistently across the catalogue.

Container photographs are frequently representative of the type and grade supplied rather than the exact unit, because stock rotates between depots. Where a listing uses representative imagery, this is indicated on the product page. The written specification and condition grade govern what is supplied.

Used and one-trip units are second-hand industrial goods. Surface wear, previous owner markings, patch repairs and minor dents are normal characteristics of those grades and are not defects.

Colour varies between units and cannot be guaranteed unless expressly agreed in writing before the order is confirmed.

Availability

Listings reflect our understanding of availability at the time of publication. Container stock moves between depots and can be sold in the interval before an order is confirmed.

If a unit you ordered is no longer available, we will contact you to offer an equivalent alternative, a revised timeframe, or a full refund of any amount paid.

Pricing and errors

Prices are shown in the currency indicated on the product page and exclude delivery unless expressly stated otherwise. Delivery is quoted separately based on destination, access and offload method.

California sales tax is applied where required under California law. Customers outside California may have different tax obligations; applicable taxes and duties will be itemised on your invoice.

Occasionally a price or specification may be published in error. Where an error is obvious and could reasonably have been recognised as a mistake, we are not obliged to supply at the incorrect price; we will contact you to confirm, re-quote or cancel and refund.

Orders and contract formation

An order placed through this website is an offer to purchase, not an accepted contract. The contract is formed when we confirm the order after checking availability and, where applicable, receiving payment.

Order acknowledgement emails and on-screen confirmations record that we have received your order; they do not by themselves constitute acceptance.

Payment

Two payment methods are offered: credit card via a secure payment link issued after your order, and bank transfer using the instructions provided with your order confirmation.

No card number, expiry date or security code is ever entered on this website. Full detail is set out on our Payment Information page.

Intellectual property

The website design, logo, written content, product descriptions and photography are owned by or licensed to Pacific Containers Terminal and are protected by intellectual property law. You may view and print pages for your own business use in connection with an enquiry or order.

Liability

Nothing in these terms limits liability for death or personal injury caused by negligence, for fraud, or for any liability that cannot lawfully be limited.

Subject to that, we are not liable for indirect or consequential loss, loss of profit, loss of contracts, business interruption or wasted expenditure arising from a delay in delivery or from a unit's suitability for a purpose we were not told about.

Containers are industrial goods. It is your responsibility to confirm that the size, grade and specification suit your intended use, and to obtain any planning permission, permit or consent required to site a container at your location.

Our total liability to you for any claim arising from an order shall not exceed the amount you paid for that order. Nothing in these terms affects any rights you have under applicable California or federal consumer protection law.

Governing law and disputes

These terms and any dispute arising from them are governed by the laws of the State of California, United States, without regard to its conflict-of-law provisions. Any dispute that cannot be resolved directly will be subject to the exclusive jurisdiction of the state and federal courts located in Los Angeles County, California.
